The Wallflower Gallery's Original Music Policy

As an innovative, multi-media arts facility, The Wallflower Gallery maintains an all-original music format.  This means that performers are only allowed to play their own original pieces.  This format coincides with standard music licensing permits of copyrighted materials and maintains a policy of original music only at The Wallflower Gallery.  This policy works to clarify the position of The Wallflower Gallery as the host venue and protects the business from deviations from the policy by the performers.

As an all ages arts venue, The Wallflower Gallery does not have the financial resources to pay the annual fees for the music licensing fees from ASCAP, BMI and SESAC.  Therefore The Wallflower Gallery works to maintain that the music presented at The Wallflower Gallery is original compositions presented by the artists.

At The Wallflower Gallery, it is our strict policy that only original compositions may be performed.  The only exceptions that are permitted are pieces that are part of the Public Domain and therefore have no Copyright Restrictions.

Any performance of musical pieces that is not an original composition of the performer shall be at the sole risk and liability of the performer.  Performer agrees to indemnify and hold harmless The Wallflower Gallery, its employees, owners, agents, and volunteers for any violation of this policy.  Such indemnity shall include payment of fines, penalties, reasonable court costs and attorney's fees in the event that The Wallflower Gallery must hire an attorney to enforce the terms of this agreement.
